Terms & Conditions
These terms and conditions apply to services provided by POWER SAVINGS NETWORK LIMITED trading as Power Saving Network. The customer using our services is referred to as the Customer.
1. Definitions
Agreement means the contractual relationship between Power Saving Network and the Customer, including these terms and any letter of authority or service instruction.
Services means the business utility support services we provide, including presenting supply options, assisting with electricity, gas, water, waste or merchant service arrangements, and supporting contract administration where applicable.
Supplier means the supplier or service provider that the Customer chooses to contract with.
Commission Payment means any payment Power Saving Network may receive from a Supplier or service provider as a result of the Customer entering into a contract.
2. Supply of services
The Customer agrees that any signed letter of authority, acceptance of a quotation, instruction to proceed, or other written confirmation may form a request for Power Saving Network to provide Services. Power Saving Network will use reasonable care and skill when providing the Services.
Power Saving Network is not a price comparison service and does not guarantee access to every supplier or every product in the market. We consider a range of factors when discussing suitable options, which may include price, contract length, supplier requirements, service suitability, customer circumstances and market availability.
3. Customer obligations
The Customer agrees to co-operate with Power Saving Network, provide accurate and complete information, respond to reasonable requests, comply with supplier terms, make payments due to suppliers, and notify Power Saving Network promptly of any change in circumstances that may affect a contract or proposed contract.
The Customer must not knowingly provide false, misleading or incomplete information and must not take steps that prevent Power Saving Network from receiving any agreed or expected Commission Payment as a result of a contract arranged through our Services.
4. Contracts with suppliers
Where the Customer enters into a contract with a Supplier, that contract is between the Customer and the Supplier. Power Saving Network is not responsible for the Supplier's performance, pricing changes outside our control, or the Customer's obligations under the Supplier contract.
5. Commission disclosure
The Customer acknowledges that Power Saving Network may receive a Commission Payment from a Supplier or service provider. The timing and amount of commission can vary. Commission may be included within the price charged by the Supplier. Customers may request further information about commission by contacting contact@powersavingnetwork.co.uk.
6. Customer breach, cancellation or failure to proceed
If the Customer breaches these terms, provides inaccurate information, cancels after instructing Power Saving Network to proceed, enters into another contract for the same supply period, prevents contract completion, or causes a Supplier to withhold commission, Power Saving Network may seek to recover losses, costs, unpaid commission, or a reasonable administration charge where permitted by law.
7. Change of tenancy or occupancy
The Customer must notify Power Saving Network as soon as possible if they intend to vacate premises, change tenancy, change occupancy, sell or transfer the business, or otherwise alter circumstances that may affect a supply contract. Supporting evidence may be requested. Failure to provide timely notice may result in Supplier fees, contract issues or loss of commission.
8. Limitation of liability
Nothing in these terms excludes liability that cannot legally be excluded. Subject to this, Power Saving Network is not liable for loss of profit, loss of business, loss of anticipated savings, loss of goodwill, indirect loss or consequential loss. Power Saving Network's total liability in relation to the Services shall not exceed the Commission Payment received by Power Saving Network in relation to the relevant contract, unless otherwise required by law.
9. Data protection
Power Saving Network will process information in line with applicable UK data protection legislation and our Privacy Policy. The Customer agrees that relevant contact and business information may be shared with Suppliers and service providers where required to provide the Services.
10. Confidentiality
Each party agrees to keep confidential information received from the other party confidential, except where disclosure is required to provide the Services, comply with law, obtain professional advice or enforce rights under these terms.
11. Notices
Notices should be sent in writing by email or post using the contact details provided by the relevant party. Notices to Power Saving Network may be sent to contact@powersavingnetwork.co.uk.
12. Dispute resolution
The parties will try to resolve any dispute in good faith. If a dispute cannot be resolved through discussion, either party may pursue legal remedies.
13. General
These terms are governed by the laws of England and Wales and the parties submit to the jurisdiction of the courts of England and Wales. If any term is found to be invalid or unenforceable, the remaining terms will continue to apply.
